Maji Super Tours – Universal Terms of Participation & Liability Waiver
Applies to ALL tours and bookings from ANY source
(effective automatically upon booking or joining the tour)
By booking or participating in any tour, activity, transportation, or service provided by Maji Super Tours (“the Company”), you (“the Guest”) agree to the following legally binding terms, regardless of where or how the reservation is made.
1. Assumption of Risk & Liability Release
You fully understand that participating in tours involves inherent risks, including but not limited to:
- Walking in crowded environments, uneven surfaces, stairs, curbs
- Rapid weather changes & natural conditions
- Traffic hazards during vehicle transportation
- Interaction with food, drink, and local environments
- Cultural activities outside controlled settings
To the fullest extent permitted by law, you waive all claims and release Maji Super Tours, its owners, employees, freelance guides, contractors, and partners from liability for:
- Personal injury, illness, or death
- Lost, stolen, or damaged personal belongings
- Emotional distress or discomfort
- Itinerary changes, delays, or temporary site closures
- Financial losses due to situations outside our control
This waiver applies even if damage or injury is partly caused by Company or staff negligence.
2. Personal Health & Safety Responsibility
You confirm that you:
- Are physically and mentally able to participate safely
- Will follow all safety instructions provided by the guide
- Will disclose medical issues, allergies, or mobility limitations before participation
You are solely responsible for medical costs, emergency transportation, and personal health decisions.
3. Transportation & On-Tour Conduct
When the tour includes Company transportation:
- Seat belts must be worn at all times
- Guests may not enter the vehicle while intoxicated
- You are responsible for any property damage you cause
The Company is not responsible for:
- Motion sickness
- Items left in the vehicle
- Damage resulting from improper use of seats, doors, or luggage handling
4. Itinerary Adjustments / Force Majeure
Tour inclusions (e.g., attractions, restaurants, events, views) may change due to:
- Weather or natural forces
- Venue rules or closures
- Local holidays, traffic, strikes, or crowding
- Safety concerns
Guides reserve full authority to adjust the schedule as needed.
Such changes are not grounds for refund.
5. Food, Drinks & Alcohol
Where food or beverages are included:
- Participation is voluntary and at your own risk
- You must manage dietary restrictions & allergies
- The Company is not liable for reactions or foodborne illness
Alcohol consumption must always remain responsible.
Dangerous intoxication may result in immediate removal without refund.
6. Behavioral Expectations
You agree to treat others with respect.
Disruptive, unsafe, threatening, or illegal behavior may result in:
- Immediate removal from the tour
- Responsibility for resulting costs
- No refund will be provided
Parents are fully responsible for supervising minors at all times.
7. Media Release
Photographs and videos may be taken during the tour.
Unless you notify the guide before the tour begins, you grant the Company permission to use your likeness in marketing materials without compensation.
8. Independent Contractor Guides
Guides engaged by the Company are independent contractors.
The Company is not liable for:
- Injuries to the guide
- Damage or injury caused by the guide
By accepting assignments, guides similarly waive liability claims against the Company.
9. Binding Law & Acceptance Without Signature
This Waiver & Terms apply:
- Worldwide
- To every booking channel
- To every participant including replacements or added guests
By booking or attending the tour, you confirm that you:
✔ Have read and understood these terms (or had opportunity to do so)
✔ Voluntarily accept all risks of participation
✔ Release Maji Super Tours from all liability as outlined above
This agreement is governed by Japanese law and binding upon heirs and legal successors.
